Terms of Service

Before using any of our products or services, please carefully read our terms of service. You consent to be legally bound by these terms by using our services.

1. Introduction

Technology-related services from Xiraa Tech Solutions include a blog, videos, forums, a digital store, web hosting options, and a section on blockchain and cryptocurrencies with visualization tools. Themes, templates, designs, images, renderings, icons, and other digital goods are available for purchase in our online store.

2. Use of our Services

You acknowledge that by using our services, you are subject to all applicable laws and regulations. Additionally, you promise not to use our services for any prohibited or unlawful activities. All content, including blog comments, forum posts, and product reviews that you submit to our website is totally your responsibility. You promise not to contribute any offensive, vulgar, or otherwise inappropriate material.

3. Copyright and Intellectual Property

The information, graphics, photos, videos, and software that make up our website all belong to Xiraa Tech Solutions or their respective owners and are all protected by copyright laws. Without our written permission, you are not permitted to copy, edit, distribute, or reproduce any content.

4. Digital Shop 

We provide a variety of digital goods for sale in our digital shop, including themes, templates, designs, graphics, renderings, and icons. We provide no warranties or assurances on the quality or suitability of any products; they are all offered “as is.” We don’t give returns, and all sales are final.

5. Web Hosting Solution

With a web-based control panel, we provide web hosting services. The security of your account, including the login information and any information saved on our systems, is your entire responsibility. In the event that we suspect a violation of these terms of service, we reserve the right to suspend or terminate your account at any time.

Backup and Loss: You use this service entirely at your own risk. As a courtesy, we offer you our backup service. Xiraa Tech Solutions is not liable for any files or data stored on your account. You agree to accept all responsibility for files and data transferred, as well as to keep all necessary backups of files and data saved on Xiraa Tech Solutions’ servers. Backups will not be supplied for accounts that have been suspended or terminated for any reason, unless Xiraa Tech Solutions agrees in writing otherwise.

Uptime Guarantee: Xiraa tech Solutions doesn’t own any datacenter, it takes servers on rent from another provider. The 99% up time guarantee only applies to shared/reseller solutions and depends on datacenter infrastructure, maintenance etc.

Zero Tolerance Spam Policy: We have a zero-tolerance policy for unsolicited email, emailing in mass, and spam. “Safe lists”, purchased lists, and the sale of lists will be considered spam. The account of any user who transmits spam will be terminated without warning. Sites promoted via SPAM (Spamvertised) are not permitted to be hosted on our servers. This provision includes SPAM sent via fax, phone, postal mail, email, instant messaging, or usenet/newsgroups, but is not limited to these methods. No entity or organization listed in the ROKSO may be hosted on our servers. Any account that causes our IP space to be blacklisted will be suspended and/or terminated immediately. Xiraa Tech Solutions reserves the right to require modifications or disable as necessary any website, account, database, or other component that does not comply with its established policies, or to make any such emergency modifications at its sole discretion.
Xiraa Tech Solutions reserves the right to charge the owner of the account used to send unsolicited email a fee for account cleanup and any blacklist removal costs. This cost of the cleaning fee is entirely at Xiraa Tech Solutions’ discretion.

Bandwidth Usage: You receive a monthly bandwidth allocation. Depending on the hosting plan you purchase, this limit may vary. Should your account exceed the bandwidth allotment, we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased for an additional fee, suspend the account until you upgrade to a higher-tier package, terminate the account, and/or charge you a fee for the overages. Unused monthly transfer cannot be transferred over to the following month.

Resellers’ Responsibility: Resellers are accountable for providing customer service. Xiraa Tech Solutions does not provide support to the clients of our Resellers. If a client of a reseller contacts us, we reserve the right to suspend the client’s account until the reseller can undertake responsibility for the client. For security reasons, all support requests must be submitted by the reseller on behalf of their consumers. Additionally, resellers are responsible for all content stored or transmitted under their reseller account, as well as their clients’ actions. Any reseller whose clients violate the law or the conditions of service will be held responsible by Xiraa Tech Solutions. A $20 administrative fee may be assessed to reactivate a Reseller account that has been suspended due to account abuse.

Acceptable Usage:

You may only utilize Xiraa Tech Solutions’ services for lawful purposes. It is prohibited to transmit, store, or present any information, data, or content that violates the laws and codes of Government of India. This includes, but is not limited to, copyrighted content, menacing or obscene content, and content protected by trade secrets or other statutes. You agree to indemnify and hold harmless  Xiraa Tech Solutions against any claims arising from your use of the service that cause you or a third party injury.

Xiraa Tech Solutions reserves the right to terminate services for any customer or End User action that exposes it to legal liability or jeopardizes its ability to serve other customers. Below is a list of Services whose content, links, or actions violate this agreement. This list is not exhaustive, but is intended to help you determine whether  Xiraa Tech Solutions is the right service provider for you:

  • Child Pornography – Hosting, Distributing, or Linking to Pornography Involving a Person Under the Legal Age.
  • CPU/Memory/Resource Abuse – Consuming an Excessive Amount of Server Resources, Causing Server Performance Issues.
  • DoS Source – Source of a Denial of Service Attack Forgery – Impersonating an IP Address, Hostname, or Email Header.
  • Fraud Site – Hosting or Linking to an Intentionally Deceptive Website HYIP – Hosting or Connecting to a High Return Investment Program Website.
  • Hosting, distributing, or linking to stolen account identification constitutes identity theft.
  • Infecting Data – Hosting, Distributing, or Linking to Exploits, Rats, Trojans, Viruses or Worms.
  • Phishing – Email-Based Identity Theft Under False Pretext.
  • Unsolicited Commercial Email (UCE) or Unsolicited Bulk Email (UBE) are examples of spam email.
  • Hosting, distributing, or linking to email address lists used for spam is prohibited.
  • Spam Site – A Website Promoted Via Spam Email or Spam Web Spam Software – Hosting, distributing, or linking to spam-generating software.
  • Web Spam – Unsolicited, Mass, or Fake Site Promotion in Web Logs, Forums, and Guestbooks.
  • Spamhaus – Spam Causing Blacklisting of an IP for Malicious Activity at www.spamhaus.org.
  • Terrorist Website – Hosting or Linking to a Terrorist Website.
  • Other content that Xiraa Tech Solutions deems menacing or offensive.

6. Crypto/Blockchain Section

Various visualization tools are available in our crypto/blockchain section for informational and educational purposes exclusively. You shouldn’t depend on the information given for investment or trading purposes because we offer no assurances about its accuracy or completeness.

7. Knowledgebase Section

Our Knowledgebase contains articles and lessons on a variety of technology-related topics. All content is given “as is,” with no warranties or guarantees regarding the accuracy or completeness of the information provided. The content is provided for informational purposes only and should not be used in place of professional advice.

8. Courses Section

Online courses on technology-related topics are available in our Courses area. All courses are sold “as is,” with no warranties or assurances about their quality or appropriateness for a specific purpose. We do not give returns on any purchases. By enrolling in a course, you agree to abide by any additional course-specific terms and conditions.

9. Refund Policy

Every sale of our digital products in our digital shop, including themes, templates, designs, graphics, renders, and icons, is final. Once a purchase has been made, no refund will be available for any reason. Likewise, all transactions of our services, such as our web hosting solutions and our Courses section, are final. We do not issue refunds under any circumstances. In the unlikely event that a digital product or service is defective or not as described, please contact us within 7 days of purchase at support@xiraa.com. We will evaluate your situation to determine whether an exception can be made.

10. Prohibition of Offensive Behavior:

Racist, intolerant, “hate”, defamatory, “stalking”, invitations to fight, menacing, and any other communication that we determine, in our sole discretion, to be inappropriate will result in immediate termination of service. Subscribers are prohibited from posting comments on online social networking, blogs, forums, or any online media websites that we perceive improper, unfair, or disrespectful to Xiraa Tech Solutions’ employees. Your account may be terminated or suspended without a refund. This includes, but is not limited to, threats of legal action, defamation, libel, public posting, and chargebacks.

11. Indemnification:

Customer agrees to defend, indemnify, save, and hold Xiraa Tech Solutions harmless  from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees, made against Xiraa Tech Solutions, its agents, its customers, officers and employees that may arise or result from any service provided or performed or agreed to be performed or any product sold by Customer, its agents, its employees, or assigns. Customer agrees to defend, indemnify, and hold Xiraa Tech Solutions harmless from liabilities arising from: (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Xiraa Tech Solutions; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement; and (4) any defective products sold to customers from Xiraa Tech Solutions’ server.

12. Limitation of Liability

Xiraa Tech Solutions will not be liable for any damages of any kind, including but not limited to direct, indirect, incidental, punitive, and consequential damages, to the fullest extent permissible by law originating from the use of our services. No matter the type of action—contract, tort, negligence, strict responsibility, or another—this limitation of liability is applicable.

13. Modifications

These terms of service are subject to change at any time without prior notice. You consent to be bound by the amended terms by using our services after such changes have been made.

14. Governing Law

Without regard to the principles of its conflict of laws, the TOS and any other agreement for Xiraa Tech Solutions shall be governed by and construed in compliance with the laws of the Constitution of India.
